Since 1993, only Local Government Areas in New South Wales can be declared as "cities" by the Government, under the Local Government Act 1993.[1] Although the present version of the Act specifies no criteria for city status,[2], a previous version of the Act specified that to be a city, a Council area must:

  • (a) have a population of at least 25,000 persons and be an independent centre of population; not being a suburb, whether residential, industrial, commercial or maritime, of any other council area or centre of population; or
  • (b) have a population of at least 150,000, and have a distinct character and entity as a centre of population beyond what would normally be regarded as being of local or suburban significance only; or
  • (c) satisfy the criteria specified in paragraphs (a) or (b) apart from the population criteria, and be an homogenous centre of importance as a focus of regional commercial, governmental or cultural activity beyond that which would normally be regarded as local, suburban, or subsidiary to another nearby centre.[3]

New South Wales, therefore, has two types of "city": urban cities proclaimed before 1993, which are still acknowledged on the register of the Geographical Names Board of New South Wales,[4] and all Local Government Areas which have been proclaimed as cities.

Police hunt thief with James Bond taste

A RARE Aston Martin DB4 GT sports car, similar to one used in James Bond movies, has been stolen from outside a Melbourne house.

The car, believed to be the only one of its kind in Australia, was parked on Whitehorse Road at Surrey Hills, in Melbourne's east, when it was taken last night.

The car, silvery-green in colour, was worth between $250,000 and $300,000, a police spokeswoman said.

The DB4 GT model made its public debut at the London Motor Show in 1959.

A prototype was driven that year by motor racing legend Stirling Moss in the International Trophy meeting at Silverstone.

In author Ian Fleming's 1959 novel Goldfinger,  secret service agent James Bond got an Aston Martin after his vintage Bentley was destroyed.

But movie producers decided on the then current DB5 model when they began production for the film in 19

Crackdown on websites, mobile content

THE Government is cracking down on online chatrooms, websites and mobile phone content to stop children looking at adult material.

New laws introduced to parliament today impose tougher regulations on companies that sell entertainment-related content on subscription internet sites and mobile phones.

"The Australian Government takes very seriously its responsibility to protect Australian citizens, particularly children, from exposure to illegal and highly offensive content delivered over convergent devices such as mobile handsets, and also over the internet more generally," Liberal MP Sussan Ley told the lower house.

"The new framework provides appropriate protections for children from being exposed to content suited only to adults while providing industry with the flexibility to explore the potential of providing entertainment and other services over new technologies."

The change follows a government review last year that found current legislation might not sufficiently protect children from inappropriate audio-visual content on mobile phones.

The Bill strengthens regulations of stored content and makes new rules for live interactive content such as chatrooms.

The new regulations would impose restrictions similar to those on traditional media content, Ms Ley said, including age verification requirements for R18+ and MA15+ material and the banning of X18+ content.

The Australian Communications and Media Authority will be able force content providers to take down offensive material and issue notices for live content to be stopped and links to the content deleted.

Providers of live services such as chatrooms must have their service professionally assessed to determine whether its "likely content" should be restricted.

"Where a content service provider fails to comply with a notice from ACMA, civil or criminal penalties may be pursued," Ms Ley said.

Penalties would also apply if the content provider simply changed pictures or videos slightly in an attempt to avoid the notice.

Content providers will have the chance to develop their own code of practice, but ACMA would step in if they were deficient.

ACMA was given an extra $16.3 million in Tuesday's federal Budget to "ensure it was adequately resourced to carry out its role as regulator in the increasingly complex communications environment", Communications Minister Helen Coonan said.

The Bill also contains provisions for an awareness campaign about the potential dangers of chat rooms, and and sets out a complaints-handling process.

Personal emails and other private communications would be excluded from the new laws, Ms Ley said, and so would news or current affairs services.

Male nanny charged over child porn

A MALE nanny allegedly caught with thousands of pornographic images of children also performed an act of indecency in front of a 12-year-old boy, a Canberra court was told today.

Aaron James Holliday, 21, was arrested at his Civic apartment yesterday after police allegedly found more than 50,000 images of child pornography and video files stored on his computers.

He appeared in ACT Magistrates Court today on two charges of possessing child pornography and committing an act of indecency in the presence of a child.

The court was told police searched Mr Holliday's apartment as part of an investigation into claims the self-employed childcare worker committed an act of indecency in front of a 12-year-old boy in July 2006.

Mr Holliday was not required to enter a plea and made no application for bail.

Magistrate Beth Campbell remanded him in custody until May 24.

A FORMER sailor who claimed he suffered a mental injury after witnessing the Voyager disaster has won $20,000 compensation after he took his case to a Victorian appeals court. John Robert Cavenett was 21 years old and a medic aboard the aircraft carrier HMAS Melbourne when it collided with the destroyer HMAS Voyager in February 1964, slicing it in half. It was Australia's worst peacetime naval disaster, claiming 82 lives during what was a routine exercise in Jervis Bay, off the New South Wa;es south coast. Mr Cavenett, now 64, initiated proceedings for damages in 1996 for post traumatic stress disorder which he said was caused by the naval disaster. He said he did not recognise the condition until he was treated by a psychiatrist in 1996. Under Victorian law these cases must be brought before the courts within six years. A Victorian Supreme Court judge initially dismissed the proceedings saying Mr Cavenett had not satisfied him that he was not aware that he suffered the condition at the time of the incident. Today at the Court of Appeal, a majority of two to one judges accepted Mr Cavenett's evidence that he did not discover his mental illness until he saw a psychiatrist in 1996. Justice Chris Maxwell said that in a case of mental injury time does not begin to run until the plaintiff knows that their mental condition is a mental illness which would be recognised by a medical professional. The court allowed the appeal and granted him $20,000 with interest dating back to 1996 plus costs. Mr Cavenett's solicitor Garry Mann said his client was happy his legal battle was finally over. "He's happy that it's over after 43 years," Mr Mann said. "It's not as good result as he would have liked but it's over." He said that since the litigation started several cases have been dealt with and about 50 were outstanding in Victoria and New South Wales.

Grill to give evidence to contempt probe

LOBBYIST Julian Grill will give evidence tomorrow at a probe into whether sacked government minister John Bowler was in contempt of West Australian parliament by giving him a confidential report.

WA parliament's procedure and privileges committee said it would interview Mr Grill, lobbyist and  business partner of former WA premier Brian Burke, tomorrow afternoon.

The committee had yet to decide if the hearing will be public, the committee's chairman Fred Riebeling said.

The committee began investigating Mr Bowler's actions after the state's Corruption and Crime Commission revealed earlier this year that in 2004, he leaked to Mr Grill a draft report of the Economics and Industry Standing Committee's probe into the closure of the Windimurra vanadium mine.

A client of Mr Grill, Precious Metals Australia (PMA), had an interest in the report because it had sold Windimurra to Swiss-based Xstrata and was receiving royalties from the mine, 600km north-east of Perth.

PMA suggested a series of changes that were included in the final report, which later helped the company win a $20 million law suit against Xstrata over the mine's closure.

Beaconsfield rocks for miners

THE northern Tasmanian town of Beaconsfield has remembered the mine disaster which killed one miner and trapped two others underground for a fortnight.

Larry Knight died in the rock fall at Beaconsfield Gold Mine on Anzac day last year, but Todd Russell and Brant Webb survived 14 nights trapped a kilometre underground.

The pair emerged from their underground prison a year ago today following a rescue, dubbed The Great Escape, that gripped the world.

Tonight, those rescuers were honoured one by one in a roll call just metres from the mine in Miners Park, while Mr Russell and Mr Webb gave their saviours custom-made buckles engraved with words of appreciation.

The pair made a separate presentation to former mine manager Matthew Gill, who became the face of the mine during the rescue operation, while Beaconsfield Primary School students unfurled a 925m “scarf of hope”.

There also was a moving service by the town's three church ministers in the packed park before Adelaide band Unitopia sang their new single 321 Hours, in recognition of the time the miners were trapped and what they experienced.

Mr Russell, Mr Webb and his wife Rachel sang backing vocals as the crowd cheered and swayed on a frosty Autumn night.

West Tamar mayor Barry Easther said it was successful evening and one that was appreciated by the Beaconsfield community.

“The way the evening rolled out gave a clear indication of who did what, and how everyone involved with the rescue went about their work,” he said.

It was now time to bring the mining accident to a conclusion.

“We will never forget the events on Anzac Day 2006, but following this first anniversary it's time to move forward and get on with our lives.

“As every anniversary comes around people in the community will have their own way of remembering the rock fall, but I do believe there is no need for further public commemorations.”

Mr Russell tonight said he was slowly rebuilding his life, adding he hoped to play football again in June.

“It's good to be here and celebrate with everyone that's turned out tonight,” he said.

“It's a rather cool night, but it's good to see everyone's here.

“I just want to say thanks to the rescuers for their efforts and thoughts throughout the past 12 months.”

Mr Webb said he was grateful to be given a chance to say thanks.

“It's great to give a little bit back to all the people who gave us so much,” he said.

“The last 12 months have been joy, to be alive, but it has taken a lot of commitment.

“Todd and I are here to honour all the rescuers. They saved our lives and reunited us with our families, so it's all good.”

Australian Workers Union national secretary Bill Shorten said he was pleased the people who “have not been at the centre of the story” had been recognised.

“The most important thing here is that a man died and the other important thing is two men were miraculously rescued,” he said.

“Perhaps part of the story which has been missing is recognition of all the very modest people who did the rescuing, so it's good to see them here.

“Also, the word closure is used by the Americans and is a bit overworked, but this is good for a bit of closure.”

He paid tribute to the town's “true grit” and “never say die” attitude.

“I would never want to be trapped a kilometre underground, but if I was I would hope Beaconsfield would come to the rescue, the people are truly amazing.”

One of the rescuers, Peter Schleich, said the anniversary, called the Beaconsfield Honours, was a chance for everyone involved to get a pat on the back.

“I worked in the tunnel to remove rocks surrounding the trapped miners, “ he said.

“The rescue was frustrating and hard at times. You were up and down all the time, but no one wanted to leave while there was hope.”
